Terms of Service

These Terms of Service ("Terms") govern your access to and use of ParticipationTown, an audience interaction tool for live polls, ratings, word clouds, open text, and anonymous questions (the "Service"), operated by AutomationTown Inc. ("AutomationTown", "we", "us", or "our"), based in Toronto, Ontario, Canada. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who these terms cover
These Terms apply both to presenters who create an account to build and run sessions, and to audience participants who join a session to respond or ask questions without an account.
Accounts
To use presenter features you must create an account through our authentication provider and provide accurate information. You are responsible for activity under your account and for keeping your sign-in method secure. You must be capable of forming a binding contract to use the Service. Notify us promptly of any unauthorized use of your account.
Acceptable use
You agree not to:
- use the Service for unlawful, harmful, deceptive, or abusive purposes;
- post or solicit content that is illegal, infringing, defamatory, harassing, or hateful;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the Service, or circumvent rate limits or security measures;
- use automated means to abuse public participation, submit spam, or stuff results; or
- misuse personal information collected through your sessions.
We may apply rate limits and other safeguards, and may disable a session or account that we reasonably believe violates these Terms.
Your content
You retain ownership of the presentations, interactions, questions, responses, and other content you create or submit ("Content"). You grant AutomationTown a non-exclusive, worldwide license to host, store, process, and display your Content solely to operate and provide the Service. You are responsible for your Content and for ensuring you have the rights to use it. As a presenter, you are responsible for the sessions you run and for handling any personal information your audience provides in accordance with applicable law.
Privacy
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms. By using the Service, you consent to the practices described there.
Third-party services
The Service relies on third-party providers (for example, authentication, database, hosting, and email). Your use may also be subject to their terms. We are not responsible for third-party services, and their availability is outside our control.
Availability and changes
The Service is offered free of charge and may change over time. We may add, modify, or discontinue features, and may limit, suspend, or end the Service or your access to it, at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that results obtained through it will be accurate or reliable.
Limitation of liability
To the maximum extent permitted by law, AutomationTown and its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or profits, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed one hundred Canadian dollars (CAD 100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless AutomationTown from any claims, damages, liabilities, and expenses arising out of your Content, your use of the Service, or your violation of these Terms or applicable law.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service or other users. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitation of liability, and indemnification.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in Toronto, Ontario for any dispute that is not subject to mandatory consumer protections in your place of residence.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.
